Terms of Service

These Terms of Service ("Terms") govern your access to phototech.site and describe the general terms under which Photo-Tech, Inc. provides photography, drone and video services. By booking a shoot you agree to these Terms.

1. About Us

Photo-Tech, Inc. is a commercial photography business located at 1310 Western Pine Circle, Sarasota, FL 34240, serving Sarasota, Manatee, Charlotte and Lee counties.

2. Website Use

• Use this site for lawful purposes only.
• Do not attempt to disrupt, damage or gain unauthorized access to the site.
• Do not copy, download or republish photographs from this site without written permission.
• Do not submit false information or use our forms for unsolicited commercial messages.

3. Bookings

• A booking is confirmed when we provide a shoot window in writing and you accept it.
• Prices are as published on our pricing page or as quoted in writing for commercial work.
• Published prices apply within 25 miles of Sarasota. Travel beyond that is billed per mile.
• You confirm you are authorized to have the property photographed and to grant us access.

4. Cancellation And Rescheduling

• Cancel or reschedule with at least 24 hours notice at no charge.
• Cancellations inside 24 hours, or a failed visit because we could not access the property, incur a trip fee as published.
• Weather related rescheduling of exterior and drone work is free.
• We will reschedule at the earliest mutual availability if illness or equipment failure prevents us from shooting.

5. Property Readiness

We provide a prep checklist at booking. The property should be photo ready on arrival. We will make minor adjustments such as opening blinds and straightening cushions, but we are not a staging or cleaning service and we will not move large furniture. Where a property is not ready, we will shoot it as presented or, if it cannot be represented fairly, propose a reschedule. Reshoots required because the property was not prepared are billed at the return rate.

6. Drone Operations

• Drone work is performed by an FAA Part 107 certified remote pilot under applicable federal regulations.
• Flights are subject to airspace restrictions, weather, wind and visibility. Some properties sit in controlled airspace requiring authorization that may be denied or delayed.
• We will not fly where regulations, HOA rules or safety conditions prohibit it, and no refund is owed for a flight that cannot legally or safely occur, though the fee for that element is not charged.
• Where drone flight is not possible, we offer elevated pole photography as an alternative where practical.

7. Editing Standards

Standard editing includes exposure blending, color correction, vertical correction, minor sensor and lens artifact removal, and sky replacement on exteriors. We will not remove or conceal permanent property defects, structural issues, neighboring buildings, power lines attached to the property or anything that would misrepresent the property to a buyer. Virtual staging is clearly labeled as virtually staged. Clients are responsible for complying with MLS rules and real estate advertising regulations regarding image representation and disclosure.

8. Delivery

Standard delivery is the next business day for photography, with video and tours as stated in your booking. Delivery is via download gallery, live for 12 months. Turnaround times are targets rather than guarantees and may extend during peak periods or equipment failure, in which case we will tell you promptly.

9. Revisions

Re edits are free within 7 days of delivery. Reshoots are free where the fault was ours. Requests beyond the agreed scope, or changes to the property after the shoot, are billed as a new booking or at the return rate.

10. Copyright And License

Photo-Tech, Inc. retains copyright in all images. Clients receive a license as described on our Licensing and Copyright page. Licenses are granted on payment in full.

11. Payment

• Payment is due on delivery unless account terms are agreed in writing.
• Gallery access is released on payment.
• Established agents and brokerages may be set up with monthly invoicing on approval.
• Past due balances may accrue interest and collection costs as permitted by Florida law.

12. Limitation Of Liability

To the maximum extent permitted by Florida law, our total liability for any claim is limited to the amount paid for the shoot giving rise to the claim. We are not liable for indirect, incidental, special or consequential damages, including lost sales, delayed listings, missed marketing deadlines or lost commissions. In the event of equipment failure, data loss or circumstances beyond our control, liability is limited to a reshoot or a refund of amounts paid.

13. Indemnification

You agree to indemnify and hold us harmless from claims arising from your use of the images, including misrepresentation claims, MLS rule violations, or claims that you lacked authority to have the property photographed.

14. Force Majeure

Neither party is liable for failure to perform due to events beyond reasonable control, including hurricanes, severe weather, flooding, airspace closures or government action.

15. Governing Law

These Terms are governed by the laws of the State of Florida. Disputes shall be brought in the state or federal courts located in Sarasota County, Florida.

16. Changes And Contact

We may revise these Terms at any time. Changes take effect when posted with an updated date.
